Four-lane Development to Proceed on Sámsoni Road
After lengthy legal proceedings, the possession of the corner property at Sámsoni Road and Acsádi Road was finalised by early February. Because of this property, the completion of the four-lane expansion of Sámsoni Road between the Mátyás Király Street junction and Simon István Street has been delayed for a long time.
Several structures stood on the property, and their demolition began on 9 February.
In response to an enquiry from Dehir.hu, the Ministry of Construction and Transport stated that only the final works following the demolition are currently taking place on the property.
The Ministry of Construction and Transport also added that, if the weather conditions are favourable, the missing section of the four-lane expansion could be completed by September this year, or by October in the case of unfavourable weather.
As previously reported, motorists were able to take possession of the more than one-kilometre-long section of Sámsoni Road expanded to two lanes in each direction in October. As part of the development, traffic lights, a service road, a cycle path, pavements and parking spaces were also constructed. Around two-thirds of the section between the Mátyás Király Street junction and Simon István Street has been completed so far. However, the road development encountered an unexpected obstacle: acquiring a property at the Acsádi Road junction delayed the works for more than a year and a half.
The expropriation procedure had already been completed long ago, and the owner of the affected property had also received the compensation payment, but considered the amount insufficient.
The Ministry of Construction and Transport – as the implementing body of the investment – requested the National Tax and Customs Administration to enforce the transfer of possession, but this was also obstructed by the owner, and the tax authority therefore imposed a fine. The owner also challenged the legality of this in court and requested the suspension of the enforcement procedure carried out by the tax authority. The Debrecen Regional Court recently rejected the claim and did not grant immediate legal protection for the property, meaning that there was no longer any legal obstacle preventing the state from taking possession of the area.
In the next and final phase, the first one kilometre of Sámsoni Road will be expanded to four lanes, for which 51 properties will need to be acquired.
This development will be carried out as part of the modernisation of the railway line between Debrecen and Nyíregyháza. The public procurement procedure to select the contractor is currently under way.
